Terms of Service

These Terms of Service govern access to and use of CertGenius AI, a certification-training SaaS operated by IEC Tech Inc. By creating an account, using the site, starting a diagnostic, purchasing course access, or using an organization workspace, you agree to these Terms.

If you use CertGenius AI on behalf of an organization, you represent that you have authority to bind that organization. If a separate signed agreement applies, that signed agreement controls where it conflicts with these Terms.

CertGenius AI provides adaptive certification training, diagnostics, readiness estimates, study planning, practice questions, flashcards, support tools, and related learning experiences. Available features depend on the course, entitlement, organization plan, and product status.

CertGenius AI is independent training software. It is not affiliated with, sponsored by, approved by, or endorsed by certification vendors or exam providers unless we state that relationship in a separate written agreement.

IEC Tech Inc. may monitor, rate-limit, watermark, log, investigate, suspend, or restrict activity to protect CertGenius AI, users, organizations, payment systems, intellectual property, and certification integrity. These controls may apply to public pages, diagnostics, practice sessions, support requests, API traffic, and admin actions.

You may not attempt to defeat tenant isolation, server-side question delivery, timer controls, entitlement gates, authentication, billing checks, audit logs, or other safeguards. Security research requires prior written permission from IEC Tech Inc.

CertGenius AI uses AI systems to generate and evaluate training content. AI-generated questions, answers, explanations, study plans, readiness estimates, and other outputs may be incomplete, outdated, or incorrect. You are responsible for reviewing important information against official exam objectives and trusted source material.

Readiness scores estimate preparation based on available signals, such as diagnostic answers, practice performance, confidence, recency, domain coverage, and study activity. A readiness score is not a promise that you will pass an exam. Except for a written pass-guarantee offer that expressly applies, IEC Tech Inc. does not reimburse exam fees or guarantee any certification outcome.

You are responsible for following the rules, candidate agreements, trademarks, exam security policies, and study-material requirements of the relevant certification vendor or exam provider. CertGenius AI does not provide exam vouchers, exam registration, or vendor authorization unless a separate offer clearly says so.

IEC Tech Inc. owns CertGenius AI, including the platform, software, design system, prompts, workflows, models of operation, generated course engine, and proprietary training experience, except for content owned by customers, users, licensors, vendors, or open-source contributors.

You receive a limited, non-exclusive, non-transferable right to use CertGenius AI for permitted training purposes during an active entitlement. You may not copy, sell, sublicense, reverse engineer, or create competing datasets from CertGenius AI.

You retain ownership of content you or your organization upload, subject to any rights held by third parties. You grant IEC Tech Inc. the rights needed to host, process, transform, display, secure, and support that content within CertGenius AI.

You represent that you have the rights needed to upload and use the content. Organization administrators are responsible for ensuring private training materials are authorized for use in their workspace.

IEC Tech Inc. may remove or restrict uploaded content if it appears unlawful, infringing, unsafe, abusive, likely to expose confidential exam materials, or likely to harm the service, users, certification vendors, or third parties.

CertGenius AI depends on third-party providers for services such as hosting, databases, authentication, payment processing, email, analytics, AI models, infrastructure, support tooling, and certification-source references. Third-party services may be unavailable, delayed, changed, or subject to their own terms.

Payment card processing is handled by Stripe or another approved processor. OAuth sign-in may be handled by providers such as Google or Microsoft. IEC Tech Inc. is not responsible for third-party provider systems outside its control.

Some courses, labs, diagnostics, authoring tools, generated explanations, readiness features, or admin workflows may be labeled beta, preview, experimental, early access, or similar. These features may change, be unavailable, contain errors, or produce unexpected results.

We may add, change, suspend, or remove features, courses, models, vendors, or integrations. We work to keep CertGenius AI reliable, but the service may be unavailable due to maintenance, incidents, provider outages, security issues, or events outside our control.

You may stop using CertGenius AI at any time. We may suspend or terminate access if you violate these Terms, create security risk, fail to pay amounts owed, misuse the service, or if continued access would violate law or harm other users.

After termination, some records may be retained as described in the Privacy Policy, including audit logs, billing records, security records, backup data, and information required for legal compliance.

CertGenius AI is provided on an as-is and as-available basis to the fullest extent allowed by law. IEC Tech Inc. does not warrant that the service will be uninterrupted, error-free, or that training content will match every exam item, vendor update, or learner need.

To the fullest extent allowed by law, IEC Tech Inc. is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, exam fees, failed exam outcomes, business interruption, or substitute services.

To the fullest extent allowed by law, IEC Tech Inc.'s aggregate liability for claims relating to CertGenius AI is limited to the amounts paid for the affected CertGenius AI access during the three months before the event giving rise to the claim, or 100 US dollars if no paid access applies.

To the fullest extent allowed by law, you will defend and indemnify IEC Tech Inc. and its officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from your content, your misuse of CertGenius AI, your violation of these Terms, your violation of certification vendor rules, or your violation of another party's rights.

These Terms are governed by applicable United States law and the laws that apply to IEC Tech Inc. in its principal place of business, without regard to conflict-of-law rules. Any dispute process, venue, arbitration, or signed customer agreement controls for that customer where it applies.

To the fullest extent allowed by law, disputes must be brought individually and not as a class, collective, consolidated, or representative action. Either party may seek emergency injunctive relief to protect security, intellectual property, confidential information, or service integrity.

We may update these Terms as CertGenius AI evolves. Material updates will be posted on this page, and continued use after an update means you accept the updated Terms unless applicable law requires a different process.
